Police officers assault & forcefully arrest nonresistant man

Two cops tackled and forcefully arrested a young man when he a bar in Bishop, CA was left with 3 girlfriends, one of which a driver. The women protested his arrest, stated that they were to leave and go home, but police took him into custody and threatened to do likewise for the women, if they do not go home. The young man had done nothing that a violent arrest justified. He was also from the bar (near the vehicle was light in the background), and he andhis friends walked alone in the dark alley toward their vehicle started by the time the officers race up to her. The officials have not identified the trouble to themselves, as the police, despite the darkness, nor do they have to be activated a siren or lights. Instead, they ran in the direction of the outgoing man and shouted at them to stop (she) has taken and inexplicably attacked the young man, placed him in a stranglehold, and threw him to the ground with enough force to dislocate his left arm on the shoulder . He waswith one arm in a sling for several weeks left, a bruised shoulder, a bruised face and a slight bruise in the shape of a boot mark on his back. The police press charges on him allegedly swung at an officer, presumably to justify his violent arrest. However, there are three witnesses and video recordings, ensure that he could do that. This is a small, rural community of 3500 people, so it is not really dangerous or anything. The only people we really fear are the cops, and this isa disgrace. Was Update: The stranglehold of the officers placed him in illegal (in the first seconds of the video here). It led also to his arm is dislocated due to the manner in which he fell, while in the choke hold. While it is justified to arrest someone for public intoxication (though) in this particular case, as he went out of its own power with a particular driver their car in a deserted street, it is not justified, a chokehold in all circumstances in California, use, and surenot for "public drunkenness" The arrest of a volatile topic. The officers are involved with Danny and Doug Nolan Mairs Bishop PD, and Sheriff Deputy Waterbury. I should note that Waterbury was very nice, some of the women and their families in the past, and they were initially happy to see him, until she noticed that he was simply there to assist the other officers in the attack . Update 2.0: The police and the prosecutors have responded to the allegations by presenting adistorted version of events (because they allegedly arrested him at the bar when he put a fight and refused to leave clearly wrong, because we were nowhere near the bar), and publication of his alleged criminal history, unrelated to the events had that night. The criminal record is an embarrassment, not only Braley, but an alleged "victim" of a few years ago, which I am sure that the media probably do not realize or consider. Here is an article about the incident, which is somewhatfull of inaccuracies (Inyo le version of events). For example, it is clear that we are not even close to the bar-it's where the car is parked in the background. I also think that it misrepresented me feel a bit like a woman, the scorn for "the local law enforcement agencies" - what a pretty general statement and is not quite right. I lived with a bishop policeman and his family at a time, and also have great respect for other officials in Inyo, including (ironically) Sheriff Lutze, who in my view agreat strategic thinker. Some of the worst people I know are in law enforcement, but that some of the best people I've met are. www.ksrw.sierrawave.net One final note: Braley had nothing to do with the attention of the media (apart from the fact that the unsuspecting subject). ----- 24th September 2007: The "resistance to state violence" and "attack on peace, an officer" have left accusations fall. Of course, there is little mention of this in the media, and pretty much emphasis on the alleged criminal history Braley(which is irrelevant).

Consensual Crimes - Not Actual Crimes

While many violent criminals free to roam and employees, and innocent people rotting in prison and on death row for crimes they did not commit, law enforcement resources are used to destroy the lives of consenting adults, do not harm anyone. An article that I prepared proposed that around four million people are arrested each year and 350,000 in prison for consensual crimes.

I consider a "consensual crime" as a criminal act committed be definedtwo or more people who agree to participate, and is not affiliated with a non-consenting individuals. The following is a non-exhaustive list of offenses considered to be agreed between the parties could be: prostitution, adultery, homosexual behavior, bestiality, gambling, some drug use (marijuana) and assisted suicide.

Another name for this type of "crime" is crime without a victim, because they do no harm, since they all had no effect on a person other than those who votedThird, with the activity. Thus, there are no victims.

If the people for these crimes, their ability to remain in employment is at risk of arrest. A conviction to a penalty virtually guarantees the loss of their livelihood. Upon discharge from prison, could impede the criminal record of their ability to find new jobs.

Even if they are not convicted of a crime, the arrest record alone can significantly harm the life. It may further job losses and difficulties in findingnew, and it may interfere with other aspects of their lives, like the ability to obtain credit to buy a car, rent an apartment, get custody of children or disagree.

Thus, the financial impact of either a conviction or imprisonment do these people need long term support from the government or charities. Or they may resort to serious offenses on what they learned from real criminals while incarcerated. This is all a big drain on the economy and is in addition to the costthe arrest, prosecution and imprisonment of them.

To avoid the conviction and imprisonment, the accused may have to spend thousands of dollars for attorney fees. For certain offenses, the amounts can run to dozens or hundreds of thousands of dollars. If the possibility of leading to financial, to themselves and their families left with nothing, some consider suicide, and so he can see as the only way out. If this takes the actions of the defendants, that the effects of capital from the loss of productivity and moreimportantly, it impacts on the family and friends of the accused.

Government shall provide that any such turbulence to protect the lives of consenting adults "them of possible consequences to occur - and they alone could - from their own freely chosen actions.

Since these arrests, the lives of innocent people, a strong argument can be made desolate, that Christian charity, together with the grace that taught about other religions and philosophies, is reason enough for leaving consenting adultsalone, but the irony is rarely seen that it is often in the name of the Christian principles that these laws are in place or follow ....

Law enforcement resources are wasted investigation consensual acts

Government focus on consensual acts will lead to more unethical behavior in other ways. To the extent that law enforcement resources are used against consenting adults, there is a corresponding reduction in resources available for collecting criminals that pose a real threatSociety, the criminals who would harm others and just try to benefit themselves.

An enormous need exists, the efforts to arrest those who raise the innocent injury. They victimize someone every two seconds in the United States, and five of six Americans may one day be victims of violent crime. According to author Peter McWilliams are, arrests committed only made for about 20% of crimes against persons or property. He says a murderer escapes into six, eightten o'clock burglars are not arrested, and only 5% of forcible rape to prison time.

McWilliams further reports that 10 billion U.S. dollars of personal property is stolen every year and never recovered. Billions more are illegally obtained by white-collar crime. Even if the person does not hurt if the victim takes an insurance case files or actions to damage, this alone binds, and may borrow resources from the economy to recover, resulting in an adverse impact, which was in any case.

WithLaw enforcement resources against consensual acts makes the U.S. more vulnerable to terrorism. According to The 9 / 11 Commission Report, in 2000 there were assigned twice as many FBI agents assigned to the enforcement of drug laws as terrorism. The FBI chief of counter-terrorism, the Commission, he indicated he intends had "500 analysts look at Osama Bin Laden ... Instead of two." And to pay former Vice President Al Gore, before 11 September, the Bush administrationMinistry of Justice had more FBI agents investigating a suspected brothel in New Orleans as the control Bin Ladin and al-Qaida.

There is obviously a strong need for law enforcement on their responses to real crimes committed against persons or things to improve. But every year in the United States is prosecuting authorities arrested some 50 billion U.S. dollars, track, and lock people who commit consensual crimes. Some estimates suggest that around half of all law enforcement resources will be used in connectionwith consensual crimes.

These funds could be a long way towards avoiding failures in dealing with the prosecution of serious crimes. Through this misallocation of resources, many violent and inhumane criminals in a position to deprive the judiciary and to continue hunting on the public. The same principle applies to the white-collar criminals who are perhaps never found ... lest we forget, the Enron and WorldCom.
