DUE PROCESS Rule of Law: The Due Process and Equal Protection Clauses protect citizens in the criminal law arena. Both the Fifth and the Fourteenth Amendments contain Due Process Clauses that are identical in language. The primary difference is that the 14th Amendment was ratified after the Civil War and deemed to give newly freed slaves the same rights as citizens. Due Process protects citizens from the government depriving them "of life, liberty, or property, without due process of law." The law generally recognizes two types of due process: procedural and substantive. 1. Procedural Due Process Procedural due process protects life and property by giving citizens advance warning that it intends to interrupt life in some way, called notice, and gives citizens their day in court to protest the government's actions, called an opportunity to be heard. Such protection is granted by the Fifth Amendment's Due Process Clause. An example is if the government plans to charge you with a crime, officials prepare a document that charges you with the crime (notice) and give you a fair trial to present your defense (opportunity to be heard).17 Procedural due process protections also extend to the following criminal procedure issues: executing search warrants; challenging the legality of an arrest; and challenging the imposition of a death ...
